Terms and Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the Awayish LLC (“Awayish,” “we,” “our,” “us”) website, services, MatchPass™, subscription plans, screening summaries, landlord tools, and any content or features offered through the Awayish platform (“Services”).

By using Awayish, creating an account, submitting an application, or purchasing any product or

subscription, you agree to these Terms. If you do not agree, do not use Awayish.

1. ABOUT AWAYISH

Awayish is a technology platform that allows renters to submit a MatchPass™ application, uses a third-party consumer reporting agency (CRS) to perform background screening when authorized, generates Awayish-formatted summary reports, and enables renters to express interest in properties. Awayish is not a property manager, leasing agent, real estate broker, or decision-maker.

Awayish does not negotiate leases, approve or deny rental applications, guarantee housing, represent landlords or tenants, provide legal or financial advice, make screening decisions, or conduct showings.

2. NON-BROKERAGE DISCLOSURE

Awayish is not a real estate brokerage and does not engage in brokerage activity. Awayish does not market or list properties on behalf of owners, does not collect commissions tied to lease value, and does not act as an agent for any user. All leasing decisions are made solely by landlords/property managers.

3. ELIGIBILITY

Users must be at least 18 years old, legally able to enter contracts, and must provide truthful and accurate information. Providing false or misleading information may result in denial or termination of services.

4. MATCHPASS™ APPLICATION

MatchPass™ is a pre-qualification product that collects applicant information, submits it to CRS for screening with authorization, and generates an Awayish summary.

MatchPass™ is not a guarantee of approval at any property. Each landlord maintains its own criteria and screening practices.

All MatchPass™ fees are non-refundable once screening begins, regardless of: changes of interest, landlord denial, user error, or CRS inability to verify information.

5. BACKGROUND SCREENING & AUTHORIZATION

CRS performs screening only with applicant authorization. Awayish accesses the full credit report, criminal background report, and eviction report provided by CRS solely for the purpose of creating the Awayish MatchPass™ summary.

 

Awayish does not download, or redistribute full credit reports. Full reports are accessed securely within the CRS platform for evaluation and summary generation only.

Screening data is the responsibility of CRS, the Consumer Reporting Agency (CRA) that provides the report. Applicants must contact the applicable credit reporting agencies directly to dispute and inaccuracies of information contained in their consumer report, as required under the Fair Credit Reporting Act (FCRA).

6. INFORMATION SHARING WITH LANDLORDS

Awayish shares applicant information only when:

1. The applicant has submitted a MatchPass™ application;

2. The applicant expresses interest in a specific property; and

3. The applicant authorizes sharing.

Awayish provides summary reports only. Landlords are solely responsible for screening decisions and compliance with Fair Housing laws.

7. LANDLORD SUBSCRIPTIONS & BILLING

Landlords may subscribe to Awayish plans. Subscription fees are billed monthly or annually,

non-refundable once charged, and automatically renew unless canceled prior to billing. Awayish may suspend access for non-payment. Landlords are responsible for ensuring listing accuracy and compliance with law.

8. PROHIBITED CONDUCT

Users may not:

  • Submit false or fraudulent applications;

  • Misuse or alter Awayish summaries;

  • Attempt to bypass screening fees;

  • Scrape, copy, or reverse engineer the platform;

  • Access data without authorization;

  • Interfere with security features;

  • Use Awayish for unlawful purposes.

Awayish may suspend or terminate accounts at its discretion.

9. INTELLECTUAL PROPERTY

Awayish owns all trademarks, branding, platform content, software, workflows, and summary formats. Users may not copy, distribute, or reproduce Awayish content without permission.

10. LIMITATION OF LIABILITY

Awayish is not liable for:

  • Landlord decisions;

  • CRS inaccuracies;

  • Property availability or pricing changes;

  • Service interruptions;

  • Errors from user-submitted information;

  • Indirect or consequential damages.

Awayish’s total liability is limited to the amount the user paid in the 30 days before the claim.

11. INDEMNIFICATION

Users agree to indemnify and hold harmless Awayish from claims resulting from: misuse of the

platform, false information, illegal conduct, or violations of these Terms.

12. MODIFICATIONS

Awayish may update these Terms at any time. Continued use after updates constitutes acceptance of revised Terms.

13. GOVERNING LAW

These Terms are governed by Minnesota law. Disputes must be resolved in Minnesota courts.

Awayish does not conduct showings, negotiate lease terms, or approve/deny rental applications. All final rental decisions are made by the landlord or property manager, in compliance with fair housing laws.

Tenant screening services are provided by [Provider Name], a FCRA-compliant consumer reporting agency. Applicants have the right to dispute inaccurate information and request a free copy of their report if used to deny housing. Awayish maintains access to consumer credit data solely for legitimate tenant-screening purposes under section

604(a)(3)(F) of the FCRA.
